The High Court allowed the bail application, granting bail to the petitioners.
Summary
The petitioners, Sanjeet Bhuiya and Ravindra Bhuiya, were arrested on 25 January 2026 in connection with a case registered under sections 8B, 20(b)(ii)C, 22, 29 and 18(b) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act for alleged cultivation of opium plants. They filed a bail application before the Patna High Court, claiming they are innocent landless workers who were merely working on land owned by co‑accused individuals. The learned counsel for the petitioners argued that the accusations are false and that the petitioners have no prior criminal record. The Court examined the submissions and, noting the lack of substantive evidence linking the petitioners to the offence, decided to grant bail. Accordingly, each petitioner was ordered to furnish a bail bond of Rs 10,000 with two sureties of the same amount, subject to the satisfaction of the Chief Judicial Magistrate, Aurangabad.
Issues considered
- Whether bail should be granted to the accused under sections 8B, 20(b)(ii)C, 22, 29 and 18(b) of the NDPS Act in the absence of strong evidentiary material.
