Santosh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Santosh Kumar, was arrested on 22 October 2025 in connection with a case registered under Sections 137(2) and 140(1) of the BNS, alleged to involve the abduction of a girl. The prosecution alleged that the petitioner abducted the victim, while the petitioner claimed innocence, asserting that the victim’s statement under Section 180 of the BNSS indicated she had eloped with him. The petitioner applied for bail, arguing that he was falsely implicated. The court examined the statements and the circumstances of the case. Finding that the victim’s statement suggested a consensual elopement and that there was insufficient ground to deny bail, the court allowed the bail application. The petitioner was ordered to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties of the same amount.
