Anticipatory bail was denied due to the nature and gravity of the offences.

Summary

The petitioners, Md. Akbar and Md. Dilwar, sought anticipatory bail fearing arrest in a murder case (Case No. 343 of 2023) involving offences under Sections 147, 148, 149, 341, 323, 324, 302, 120B, 504 and 506 of the Indian Penal Code. The prosecution alleged that the petitioners, along with others, killed the deceased using a sword, knife and axe. The investigating officer submitted that sufficient evidence had been gathered against the petitioners. Considering the seriousness and gravity of the alleged offences, the High Court declined to grant anticipatory bail and ordered the petitioners to surrender within two weeks to apply for regular bail. The Court also directed the Chief Judicial Magistrate of Araria to dispose of pending applications for process within one week and communicated the order to the District & Sessions Judge and the Superintendent of Police, Araria.

Issues considered

  • Whether anticipatory bail should be granted in a case involving murder and other serious IPC offences.
  • Whether the court can conditionally direct surrender and seek regular bail in lieu of anticipatory bail.
