Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner with specified monetary and attendance conditions.

Summary

The petitioner, Ashish Kumar Satan Yadav, was arrested in connection with the seizure of 171 litres of illicit liquor and charged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act, 2016. He had been in custody since 21‑12‑2025 and claimed innocence, a clean antecedent, and willingness to donate Rs. 25,000 to a charitable organization. The State opposed his bail application. The High Court, after considering the submissions, ordered his release on bail upon furnishing a Rs. 10,000 bond with two sureties, depositing Rs. 25,000 with Ramakrishna Mission Vidyapith, and attending Jasidih Police Station every Sunday. The Court also directed verification of his antecedent before accepting the bail bonds and clarified that the order is limited to the bail application and does not prejudice the trial. The order was communicated to the Superintendent of Police for compliance.

Issues considered

  • Whether bail should be granted to the accused in a case of possession of illicit liquor under the Bihar Prohibition and Excise Act, 2016.
  • Whether the conditions imposed by the Court are appropriate and sufficient to ensure the accused's appearance.
