Patna High Court

Pappu Sahni @ Papu SahaniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner upon furnishing the prescribed bond and sureties.

Summary

The petitioner, Pappu Sahni, applied for bail in a case registered under multiple sections of the BNS, alleging that he was falsely implicated in a violent incident that also caused injuries to both parties. He had been in custody since 20 December 2025. The prosecution argued that the offences were serious, while the petitioner’s counsel contended his innocence and highlighted his own injuries. The learned counsel for the State opposed bail. After considering the facts, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, subject to the conditions of the lower court. The order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether bail should be granted to the petitioner in a case involving offences under Sections 126(2), 115(2), 118, 109, 303(2), 352, and 3(5) of the BNS.
