Mahesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified conditions.

Summary

Mahesh Kumar was arrested on 29-12-2025 in connection with a case of manufacturing adulterated petrol, alleged under multiple sections of the Bihar Narcotic Substances Act, 2023, the Explosive Substance Act and the E.C. Act. He pleaded that he is a labourer employed by the main accused, has a clean antecedent, and was falsely implicated. The prosecution opposed his bail, citing the seriousness of the offences. The petitioner highlighted that co‑accused Hakim Hawai and Shyambabu Kumar Ram had been granted bail by a coordinate bench of the same court. Considering the petitioner’s clean record and the precedent of bail to similarly situated co‑accused, the court ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions of cooperation, presence in court, and non‑tampering with evidence.

Issues considered

  • Whether bail should be granted to the petitioner despite the grave nature of the charges under the BNS Act, Explosive Substance Act and E.C. Act.
