The Court granted anticipatory bail to the petitioner, subject to strict conditions, under Section 438(2) CrPC and Section 482(2) of the B.N.S.
Summary
The petitioner, Kanhaiya Kumar, applied for anticipatory bail in connection with a case registered under several sections of the B.N.S. and the Arms Act, alleging that the charges were fabricated due to a land dispute. The prosecution alleged that the petitioner and co‑accused assaulted an informant and that one co‑accused fired a rifle, injuring the informant. The petitioner argued that the allegations were omnibus, that co‑accused Amar Kumar had already been granted bail, and highlighted his own criminal antecedents. The State opposed the bail, citing the seriousness of the offences. The Court, after considering the submissions and the petitioner’s antecedents, granted anticipatory bail subject to a bail bond, sureties, and several conditions including regular appearance before the trial court and the Superintendent of Police. The order emphasized that the conditions are not to delay the trial and that any violation could lead to cancellation of bail.
Issues considered
- What is the appropriateness of granting anticipatory bail to the petitioner under the circumstances?
- Do the petitioner’s criminal antecedents and the nature of the alleged offences preclude anticipatory bail?
