Patna High Court

Pawan RajbharversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The Court denied regular bail to the petitioner.

Summary

Petitioner Pawan Rajbhar was arrested in connection with a case registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act, alleging that he fired upon the brother of an informant, resulting in death. He applied for regular bail, claiming innocence, a clean antecedent, and that he had been in custody since 20 January 2026. The State opposed the bail, emphasizing the seriousness of the charges and the specific accusation against the petitioner. The Court, after hearing both sides, rejected the bail application, deeming the nature and gravity of the offence sufficient to deny release. Additionally, the Court directed the trial court to expedite the trial and aim to conclude it within one year of receiving the order.
