Ram Suresh SinghversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Ram Suresh Singh, an 80‑year‑old resident of Begusarai, was arrested in connection with a property dispute and charged under IPC sections 420, 467, 468, 471, 120(B) and 34 for allegedly selling joint‑family land. The petitioner claimed he was falsely implicated, stating that the informant had previously sold his own share and that the mutation of the land was still pending. He also highlighted his advanced age, hospitalization, and that a co‑accused had previously been granted bail by the same court. The State opposed the bail application. Considering the petitioner’s health, the alleged false implication, and the precedent of bail to the co‑accused, the court allowed the regular bail, directing a bond of Rs 10,000 with two sureties. The petitioner was ordered to be released on bail pending trial.

Issues considered

  • Whether bail should be granted to an accused charged with offences under Sections 420, 467, 468, 471, 120(B) and 34 of the IPC in a property‑related case
  • Whether the petitioner’s advanced age, hospitalization and claim of false implication justify bail
  • Whether the prior grant of bail to a co‑accused influences the decision
