The Court granted bail to the petitioner.

Summary

Prince Kumar applied for bail in a case (Parbatta P.S. Case No. 382 of 2024) involving alleged violations of Sections 317(2) and 317(4) of the B.N.S. and Sections 25(1‑B)a and 26 of the Arms Act. The prosecution’s case is based on weapons recovered from the house of co‑accused Roshan Kumar, who named the petitioner, while no material was seized from the petitioner himself. The petitioner’s counsel argued that he is innocent, that the only evidence against him is the co‑accused’s statement, and that the co‑accused has already been granted bail. The State opposed bail, citing a prior criminal antecedent of the petitioner. After hearing both sides, the Court found the evidence insufficient to deny bail and ordered the petitioner to be released on a bail bond of Rs 10,000 with two sureties, subject to the satisfaction of the District and Additional Sessions Judge‑III, Khagaria.

Issues considered

  • Whether the petitioner is entitled to bail despite the co‑accused’s statement implicating him
  • Whether the presence of a prior criminal antecedent justifies denial of bail
  • Whether the lack of seized material from the petitioner warrants bail
