Patna High Court

Sonu Thakur @ Sonu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner, directing release upon furnishing a bail bond of Rs.10,000 with two sureties.

Summary

The petitioner, Sonu Thakur, applied for regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly keeping illicit liquor for sale. The police alleged that he fled the scene after a search recovered 45 litres of illicit liquor, but the petitioner claimed he was falsely implicated and that the flight allegation was fabricated. He argued that no liquor was found in his possession, he has no prior criminal record, and a co‑accused had already been granted bail. The State opposed the bail, citing the seriousness of the offence and a victim’s statement recorded under Section 183 of the B.N.S.S. The court, after considering the circumstances and the victim’s statement, ordered that the petitioner be released on bail upon furnishing a bail bond of Rs.10,000 with two sureties of equal amount. The application for bail was therefore allowed.

Issues considered

  • Whether regular bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the allegation of fleeing the scene is sufficient to deny bail.
  • Whether the petitioner’s lack of prior criminal record and the co‑accused’s bail affect the bail decision.
