Patna High Court

Teju KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, Nand Lal Kumar, a driver of a CNG auto‑rickshaw, was arrested for allegedly transporting 170 litres of illicit country‑made liquor, an offence under Section 30(a) of the Bihar Prohibition and Excise Act. He claimed he was unaware of the contraband and had no prior criminal record. The State opposed his bail, arguing the seriousness of the offence. The Court considered the facts, the petitioner’s lack of knowledge, and the length of custody, and ordered that he be released on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties of equal amount. The application for bail was therefore allowed.

Issues considered

  • Whether the driver, who claims ignorance of the illicit liquor, is entitled to regular bail under Section 30(a) of the Bihar Prohibition and Excise Act
  • Whether the non‑compliance of Section 105 of the B.N.S.S. affects the bail application
