The High Court granted anticipatory bail to the petitioners, holding that the general nature of the accusations did not preclude bail.
Summary
The petitioners, six individuals from Shankarpur village, sought anticipatory bail fearing arrest in a case registered under multiple IPC offences including assault, robbery and attempt to murder. The prosecution alleged that the petitioners, along with others, assaulted an informant and his family using lathi and khanti. The petitioners contended they were innocent, stating the incident stemmed from a land dispute and amounted only to a simple fight with injuries on both sides, and that the accusations were vague and lacked specific overt acts. The State opposed the bail, but the High Court noted the general and omnibus nature of the allegations and the existence of a case‑and‑counter‑case. Consequently, the Court granted anticipatory bail, directing each petitioner to furnish a bail bond of Rs 10,000 with two sureties, subject to conditions under Section 482(2) of the Criminal Procedure Code.
Issues considered
- Whether anticipatory bail can be granted when the accusations are general and omnibus without specific overt acts.
- Whether the petitioners are likely to be arrested under the listed IPC sections.
- Whether the High Court may impose conditions under Section 482(2) of the CrPC while granting anticipatory bail.
