BAIL GRANTED

Holding

The Court granted bail to the petitioners, directing them to furnish a bond of Rs. 10,000 each with two sureties.

Summary

The petitioners, Md. Mohid and Md. Islam, were arrested on 27 January 2026 after 433.330 litres of illicit foreign liquor were seized from two vehicles in Araria. They were charged under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, and remained in custody pending trial. The petitioners argued that they were merely gratuitous passengers, that the first petitioner had no prior record and the second had only one similar case for which he was already on bail. The State opposed the bail application, contending the seriousness of the offence. Considering the circumstances, the Court ordered that both petitioners be released on bail upon furnishing a bond of Rs. 10,000 each with two sureties, subject to the satisfaction of the Exclusive Special Judge, Excise‑I, Araria.
