The court granted regular bail to the petitioner on condition of a Rs 10,000 bail bond with two sureties.
Summary
The petitioner, Purshottam Singh, sought regular bail in a case (PS 206/2025) where he was charged under several sections of the Indian Penal Code, including offences of assault and attempt to murder. The prosecution alleged that he pushed the informant, causing her to slip down stairs and sustain injuries. The petitioner contended he was innocent, that the charge was rooted in a land dispute, and that the trial court’s order lacked a description of the informant’s injury; he also highlighted his age and the fact that he had been in custody since 8 January 2026. The State opposed bail, arguing the petitioner concealed his five prior criminal convictions, which the trial court had considered in denying bail. After hearing both sides, the High Court found the circumstances warranted bail and ordered the petitioner released on a bail bond of Rs 10,000 with two sureties. The order directed compliance with the conditions set by the Chief Judicial Magistrate, East Champaran.
Issues considered
- Whether regular bail should be granted to the petitioner pending trial for the offences alleged.
- Whether the petitioner’s prior criminal antecedents justify denial of bail.
- Whether the alleged injury to the informant and the surrounding facts warrant continued detention.
