Patna High Court

Ranjit Kumar @ Ranjit SharmaversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that bail could not be granted due to the seriousness of the offences and the pending trial, affirming the earlier dismissal.

Summary

The petitioner, Ranjit Kumar, sought regular bail for offences under Sections 115(2), 351(2), 303(2), 352, 81 and 3(5) of the Bharatiya Nyaya Sanhita, relating to alleged illegal confinement and rape of a victim. His earlier bail application was rejected on 30 July 2025, with the court noting the gravity of the offences and his custody since 25 April 2025. In the present application, the petitioner argued that four of six witnesses had already been examined, suggesting the trial was nearing conclusion. The court, however, emphasized the seriousness of the charges and the fact that the trial was still pending, and therefore declined to revisit its earlier decision. Consequently, the second bail application was dismissed, leaving the petitioner in custody.

Issues considered

  • Whether regular bail should be granted to an accused of serious offences including rape and confinement when the trial is nearing conclusion
  • Whether the gravity of the offences outweighs the petitioner's claim of trial progress
