Holding

The court granted regular bail to the petitioner.

Summary

Shambhu Kumar was arrested in connection with the alleged possession of five litres of country-made liquor, alleged under section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed innocence, asserting that no liquor was recovered from him and that the police failed to follow Section 105 of the Bihar Narcotic Substances Act while preparing the seizure list. The State opposed bail, highlighting three prior similar offences against the petitioner. After hearing both sides, the court noted the procedural irregularities and the petitioner’s prolonged custody since 28‑01‑2026, and decided to grant regular bail. The petitioner was ordered to furnish a bail bond of Rs.10,000 with two sureties of the same amount, subject to the condition that he not commit similar offences in the future.
