Patna High Court

Buchchi Mandal @ Bhuneshwar MandalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner, subject to bond and cooperation conditions.

Summary

The petitioner, Buchchi Mandal, was charged with a slew of offences under the Indian Penal Code (including sections 147, 148, 149, 341, 323, 324, 326, 307, 385, 379, 120(B), 504 and 506) and Section 27 of the Arms Act for allegedly assaulting the father of an informant with firearms, causing six injuries. The petitioner claimed he was falsely implicated, had only one prior criminal antecedent, and had been in custody since 3 December 2025. He also pointed to the fact that similarly situated co‑accused had been granted bail in three earlier criminal miscellaneous matters. The State, represented by an Additional Public Prosecutor, opposed the bail on the ground of the seriousness of the offences and the petitioner’s antecedent. After considering the circumstances, the Court allowed the regular bail, directing the petitioner to furnish a bail bond of Rs 10,000 with two sureties and to cooperate fully with the trial, failing which the bail would be cancelled.

Issues considered

  • Whether a petitioner charged with multiple serious offences under the IPC and the Arms Act, and having a prior criminal antecedent, is eligible for regular bail.
  • Whether the grant of bail to co‑accused in similar cases influences the bail decision for the petitioner.
