Holding

Anticipatory bail was denied as the court was not inclined to grant the privilege given the nature and gravity of the allegations.

Summary

The petitioner, Brajmohan Kumar, sought anticipatory bail after being named in an FIR for alleged involvement in supplying ammunition to accused persons in a loot-planning case. The FIR alleged violations of Sections 110, 111(3), 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(1‑b)a, 26 and 35 of the Arms Act. The court examined the seriousness of the allegations and the petitioner’s purported role in facilitating the offence. Considering the gravity of the accusations, the court declined to grant anticipatory bail. The order expressly limits its observations to the present application and does not prejudice any future proceedings against the petitioner.
