Patna High Court

Dhuri ManjhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to specified conditions.

Summary

The petitioner, Dhuri Manjhi, was arrested in connection with the seizure of 50 litres of illicit liquor and 2000 litres of sweet mahua solution, alleged offences under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act. He applied for regular bail, offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the bail, but the court considered the custody period, the nature of the offences, and the petitioner's undertaking. The bench allowed the bail application, directing release on a bail bond of Rs. 10,000 with two sureties of equal amount. The bail was conditioned on the deposit of Rs. 25,000 with Ramakrishna Math and mandatory monthly attendance at the police station, with default leading to cancellation.

Issues considered

  • Whether regular bail can be granted to an accused under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act.
  • Whether the conditions imposed (donation to charity and monthly police attendance) are permissible under bail law.
