Patna High Court

Md. GufranversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner is entitled to regular bail.

Summary

The petitioner, Md. Gufran, was arrested in connection with a dispute that escalated into an assault involving a group of boys playing cricket. The prosecution alleged that several individuals assaulted the victim with a wicket, but no specific allegation was made against the petitioner. The petitioner claimed innocence, arguing that the charge against him was a general, omnibus allegation without particular evidence. The State opposed bail, but the court considered the length of custody, the nature of the allegations, and the lack of specific incrimination. Consequently, the court granted regular bail, ordering a bond of Rs.10,000 with two sureties, while noting that its observations were prima facie and not to affect the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the omnibus nature of the allegations.
  • Whether the specific provisions of the Bharatiya Nyaya Sanhita, 2023, justify denial of bail.
