Holding

The Court held that bail could not be granted in view of the substantial quantity of narcotics recovered and the seriousness of the offence.

Summary

The petitioner, Niraj Kumar Ram, was arrested on 21 September 2024 in connection with a case registered under Jogbani Police Station (Case No. 192 of 2024) for alleged contravention of Section 20(B)(ii)(c) of the NDPS Act. The police recovered 114.5 kg of ganja, leading to the filing of a regular bail application. The petitioner’s first bail application was dismissed on 19 February 2025, and a second attempt was made before this Court on 30 April 2026. The Court examined the magnitude of the drug seizure and the seriousness of the offence, finding no sufficient ground to grant bail. Consequently, the Court upheld its earlier order, rejected the second bail application, and directed the trial court to expedite the trial.
