Patna High Court

Bhoj Ali DewanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

Bhoj Ali Dewan was arrested in connection with the recovery of 10.7 kg of ganja and charged under sections 8, 20(b)(ii)(b), 23(b) of the NDPS Act and section 317(5) of the Bihar Narcotic Substances Act, 2023. He had been in custody since 23 February 2025 and his earlier bail application was rejected. The petitioner claimed a clean antecedent and highlighted the delay in trial. The Patna High Court, noting the prolonged custody and lack of prior convictions, allowed the bail application on the condition of a Rs.10,000 bond, two sureties who are close relatives, verification of antecedent, and mandatory weekly attendance at the police station. Any default would lead to cancellation of bail.

Issues considered

  • Whether bail should be granted in a case involving large quantity of narcotics under the NDPS Act and B.N.S. 2023.
  • Whether the delay in trial and alleged clean antecedent justify bail despite the seriousness of the offence.
