Anticipatory bail was granted to the petitioners subject to conditions under Section 482(2) CrPC.
Summary
The petitioners, Chandrama Paswan and Mina Devi, who are the father‑in‑law and mother‑in‑law of the complainant, sought anticipatory bail in a dowry harassment case. The complaint alleged that they, along with others, tortured and harassed the complainant for dowry, evicted her from her matrimonial home and facilitated a second marriage of her husband, invoking Sections 85, 82(1), 115(2) and 126(2) of the B.N.S. and Sections 3 and 4 of the Dowry Prohibition Act. The petitioners contended they were innocent, had no specific allegations against them, and possessed clean antecedents. The State opposed the bail. Considering the general and omnibus nature of the accusations and the petitioners' clean record, the court granted anticipatory bail, directing them to furnish a bail bond of Rs.10,000 each with two sureties, within eight weeks, subject to Section 482(2) of the CrPC.
Issues considered
- Whether anticipatory bail should be granted to the petitioners despite the general nature of the dowry harassment allegations.
- Whether the clean antecedents of the petitioners justify the grant of anticipatory bail.
