Patna High Court

Chandan KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that regular bail could not be granted to the petitioner.

Summary

The petitioner, Chandan Kumar Vinod Rai, was charged under Sections 109(1), 308(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act for allegedly demanding extortion and shooting the victim, causing chest injury. He has been in custody since 27 September 2025 and possesses three prior criminal convictions. The petitioner applied for regular bail, arguing that he should be released pending trial. The court examined the seriousness of the alleged offences, the intent to kill, and the petitioner’s criminal antecedents, and concluded that the nature and gravity of the case warranted denial of bail. Consequently, the application for regular bail was rejected, with the court noting that its observations were prima facie and not to prejudice the trial.

Issues considered

  • Whether regular bail should be granted to the petitioner given the seriousness of the offences under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the petitioner’s prior criminal antecedents and the alleged intent to kill preclude the grant of bail
