Decided

DISMISSED

Holding

The court held that regular bail could not be granted in view of the seriousness of the allegations under the Arms Act.

Summary

The petitioner, Sujeet Kumar, was arrested in connection with a case registered under the Arms Act for alleged conspiracy to supply illegal weapons, with five country-made pistols recovered from his residence. He has been in custody since 10 October 2025. The petitioner applied for regular bail, arguing that he should be released pending trial. The court examined the seriousness of the allegations, noting prima facie material indicating his involvement in the offence. Considering the grave nature of the charges under Sections 25(1‑b)a, 26 and 35 of the Arms Act, the court declined to grant bail. The application for regular bail was therefore rejected, with the court emphasizing that its observations are limited to the bail application and do not prejudice the trial.
