Patna High Court

Arjun KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner with specified conditions.

Summary

Arjun Kumar was arrested for possession of 114.450 liters of illicit liquor, alleged to violate Sections 30(a), 32(i)(iii) and 41(i)(ii) of the Bihar Prohibition and Excise Act. He had been in custody since 3 February 2026 and asserted a clean antecedent. The petitioner offered to donate Rs.25,000 to a charitable organization without admitting guilt, while the State opposed his bail. The Court, after weighing the custody period, nature of the offence and the parties' submissions, allowed the bail application. He was ordered to be released on a Rs.10,000 bail bond with two sureties, subject to conditions of the donation, monthly attendance at the police station, and verification of his antecedents. The Court noted that its observations are prima facie and will not influence the trial.
