Patna High Court

Chandan Kumar @ Chandan RaiversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that bail could not be granted because of the petitioner’s criminal antecedents and alleged participation as an informer, rendering him a flight risk and a threat to the investigation.

Summary

The petitioner, Chandan Kumar, applied for regular bail in a case registered under Sections 302/34 of the Indian Penal Code and Sections 25(1‑b)a, 26, 27, 35 of the Arms Act. The prosecution alleged that the deceased was killed by unknown criminals and that the petitioner had acted as an informer, revealing the victim’s whereabouts to the perpetrators. The petitioner claimed innocence, asserted that he had been falsely implicated, and highlighted his willingness to cooperate with the trial. The Additional Public Prosecutor opposed bail, emphasizing the petitioner’s criminal antecedents and his alleged role in the investigation. The court, after considering the seriousness of the offences and the petitioner’s past record, declined to grant bail. Consequently, the bail application was dismissed.

Issues considered

  • Whether the petitioner is entitled to regular bail despite his criminal antecedents and alleged role as an informer.
  • Whether the nature of the offences under the IPC and Arms Act warrants denial of bail.
