Holding

Bail was denied to the petitioner.

Summary

Amit Kumar Singh applied for bail in a case registered in 2018 involving offences under IPC sections 326, 307, 120(b), 302 and Arms Act section 27. The prosecution alleged that unknown assailants fired on a victim‑informant during a loot incident. The petitioner had been in custody since 27‑03‑2024 and possessed eight prior criminal convictions. The Patna High Court, after hearing counsel, found the seriousness of the charges and the petitioner’s antecedents warranted denial of bail. The application was dismissed, with the court noting that its observations were limited to the bail application and did not prejudice the trial’s merits.

Issues considered

  • Whether bail should be granted to the petitioner in view of the grave nature of the offences (IPC 326, 307, 120(b), 302 and Arms Act 27) and his criminal antecedents?
