DISMISSED

Holding

Bail was not granted to the petitioner; the application was dismissed.

Summary

The petitioner, Ravindra Kumar, was arrested in connection with a kidnapping case (PS Case No. 79 of 2025) where three brothers were abducted and a ransom of Rs. 29,000 was demanded and received. He is charged under Sections 140(2), 111 and 3(5) of the Bihar Narcotic Substances Act, 2023, and is named in the self‑inculpatory statement of a co‑accused. The petitioner applied for bail, arguing that he had been in custody since 3 January 2026. The Court examined the seriousness of the offence, the fact that the petitioner was implicated by a co‑accused’s statement, and the nature of the kidnapping and ransom. Concluding that the circumstances did not warrant release, the Court refused bail and dismissed the application.

Issues considered

  • Whether the petitioner is entitled to bail under Sections 140(2), 111 and 3(5) of the Bihar Narcotic Substances Act, 2023 in a kidnapping‑ransom case
  • Whether the self‑inculpatory statement of a co‑accused and the seriousness of the offence preclude the grant of bail
