Decided

BAIL GRANTED

Holding

Bail is granted to the petitioner subject to a Rs.10,000 bond, two sureties, and monthly police station attendance.

Summary

Baniya Devi was arrested for alleged possession of 10.05 litres of illicit foreign liquor, an offence under Section 30(a) of the Bihar Prohibition and Excise Act. She applied for bail, claiming innocence despite having two prior criminal antecedents and having been in custody since 26 February 2026. The State opposed the bail application. The Court examined the facts, the nature of the offence, and the petitioner’s circumstances, and decided to grant bail on the condition of a Rs.10,000 bond with two sureties and monthly attendance at the police station. The order also stipulated that failure to appear would lead to cancellation of the bail bonds.
