Patna High Court

Sunil Kumar @ Sunil PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, finding no incriminating article recovered from his possession and deeming the circumstances sufficient for release.

Summary

Sunil Kumar was arrested in connection with the seizure of 611.7 liters of illicit foreign liquor under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner contended that he was neither the owner nor the driver of the vehicle and that no incriminating article was found in his possession, asserting his innocence. The State opposed his bail application, arguing the seriousness of the offence. The Court, noting the absence of any incriminating material linked to the petitioner and the period of his custody, granted bail. He was released on a bail bond of Rs. 10,000 with two sureties of the same amount, subject to the satisfaction of the Exclusive Special Excise Court.
