Decided
Disposal
DISMISSED

Holding

The bail application was dismissed; the petitioner was not granted bail.

Summary

The petitioner, Dhanji Singh, was arrested in connection with a case alleging that he fired upon an injured person during a land dispute. He is charged under Sections 109(1), 303(2) read with Section 3(5) of the B.N.S. and Section 27 of the Arms Act. The petitioner applied for bail, claiming innocence and a single prior criminal antecedent, while the prosecution relied on an injury report to substantiate the firing allegation. The court examined the seriousness of the alleged offence and the supporting medical evidence, and concluded that the allegations warranted denial of bail at this stage. Consequently, the bail application was dismissed, with a direction that the petitioner may re‑apply if the trial is unduly delayed.

Issues considered

  • Whether bail should be granted to the accused in view of the alleged firing and injury under the specified sections of the B.N.S. and the Arms Act
  • Whether the presence of an injury report and the nature of the offences justify denial of bail
