The court held that typographical errors in the earlier order may be rectified by amendment, and the bail conditions remain as originally stipulated.

Summary

The petitioner, Deepak Kumar, sought relief fearing arrest in connection with Ranitalab Police Station Case No. 454 of 2025 under section 30(a) of the Bihar Prohibition and Excise Act. An earlier order dated 17-02-2026 granted bail but contained typographical errors, misnaming the police station as Raniya Talab and incorrectly stating the case year as 2024. The petitioner moved the court to correct these mistakes. The court examined whether such clerical errors could be rectified without a fresh hearing. It held that the order could be amended to correct the title, police‑station name, and case year while preserving the bail conditions. Consequently, the order was modified to reflect the correct details and the period for surrender was extended by four weeks.
