Holding

The Court granted regular bail to the petitioner.

Summary

Ranjan Kumar Sharma was arrested in connection with the recovery of 585 litres of illicit country-made liquor, a pistol and two bullets, and charged under Sections 132, 109 and 281 of the Bihar Narcotic Substances Act, 2023 and Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act. The petitioner applied for regular bail, asserting innocence, a clean antecedent and that no Time Investigation Procedure (TIP) had been conducted by the police. The State opposed the bail on the seriousness of the offences. The Court, noting the absence of a TIP, the petitioner’s clean record and the circumstances of the case, allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties. The order was made on a prima facie basis and does not prejudice the merits of the trial.

Issues considered

  • Whether regular bail should be granted to the accused under the Bihar Narcotic Substances Act, 2023 and the Bihar Prohibition and Excise Act in the absence of a TIP and with a clean antecedent.
  • Whether the nature of the offences involving illicit liquor and illegal arms precludes the grant of bail.
