DISMISSED

Holding

The Court held that bail could not be granted and dismissed the application.

Summary

Banty Yadav applied for bail in a case registered under Sections 25(1‑B)a, 26 and 35 of the Arms Act relating to a loot of Rs. 14,01,500 from Airtel Payments Bank, during which the victim was shot. The prosecution alleges that the loot was recovered from a co‑accused who identified Yadav as a participant. Yadav has been in custody since 27 January 2025, and a prior bail application in a related case (Sherghati P.S. Case No. 393 of 2024) was rejected. The High Court examined the seriousness of the offences, the presence of a weapon, and the prior denial of bail. Concluding that the circumstances did not warrant release, the Court dismissed the bail application.
