Patna High Court

Ritik Kumar ChaurasiyaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond and specified conditions.

Summary

Ritik Kumar Chaurasiya was arrested on 9 May 2025 in connection with an FIR alleging violations of Sections 30(a) and 32(3) of the Bihar Prohibition & Excise Act, 2016, based on the recovery of 56 litres of country‑made liquor from a Toto. The petitioner contended that the liquor was not in his conscious possession, that he was neither the owner nor the driver of the vehicle, and that the FIR was fabricated, also pointing to non‑compliance of Section 103 of the BNSS, 2023. The State opposed bail, noting a similar pending case but acknowledging the petitioner was already on bail in that matter. The Court, after considering the lack of direct possession and procedural lapses, granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding cooperation, non‑tampering with evidence, and verification of criminal antecedents. The bail order was directed to be implemented without delay for verification purposes.

Issues considered

  • Whether bail should be granted when the alleged contraband was not recovered from the petitioner's conscious possession.
  • Whether non‑compliance of Section 103 of the BNSS, 2023, warrants the grant of bail.
  • Whether the existence of another pending case affects the petitioner's entitlement to bail in the present matter.

of similar nature other than the present one but fairly submits on

the basis of paragraph-3 of the bail petition that the petitioner is

on bail in the pending matter.
