Patna High Court

Rambahadur Kamat @ Rambahadur KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to a bail bond and sureties.

Summary

The petitioner, Rambahadur Kamat, sought anticipatory bail fearing arrest in a case registered under Sections 191(2), 115(2), 118(1), 109, 74 and 351(2) of the B.N.S., alleging he assaulted an informant with a Farsa. He contended he was falsely implicated and that the injuries caused were simple in nature. The State opposed the bail, arguing the seriousness of the offences. The Court, after considering the modest nature of the alleged injuries and the petitioner's claim of innocence, granted anticipatory bail. The order directed that if arrested within eight weeks, the petitioner be released on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted in the present case
  • Whether the allegations under the cited sections warrant denial of bail
  • Whether conditions under Section 482(2) of the B.N.S.S. are applicable
