Patna High Court

Anil Kumar RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner.

Summary

Anil Kumar Rai was charged under Sections 103(1), 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 for the alleged murder of an informant's husband. The prosecution alleged that Rai and a co‑accused lured the victim to a house under the pretext of making sweets and that the victim's body was later found near his motorcycle. Rai contended that he was falsely implicated, there were no eyewitnesses, and the death was likely accidental, with the cause of death still under forensic examination. He also highlighted that a co‑accused had previously been granted bail in a similar case. After hearing both sides, the court decided to release Rai on bail, requiring a bond of Rs.10,000 and two sureties of the same amount, subject to the satisfaction of the Additional Sessions Judge, Dalsingsarai.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious nature of the offences under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the prosecution evidence is sufficient to justify denial of bail.
