Patna High Court

Amit ThakurversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to the stipulated conditions.

Summary

The petitioner, Amit Thakur, was arrested on 10 January 2026 in connection with an excise case involving the seizure of 876 litres of whisky. He sought bail, claiming he had no conscious possession of the liquor, which was recovered from the home and vehicle of co‑accused persons, and that he has a clean antecedent. The petitioner also argued that the prosecution had failed to comply with Section 103 of the Bihar Negotiable Substances (BNSS) provisions. The Additional Public Prosecutor opposed bail. The Court, noting the petitioner’s clean record and the alleged procedural lapse, granted bail on a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
  • Whether the alleged non‑compliance of Section 103 of BNSS warrants bail.
  • Whether the petitioner’s clean antecedent and lack of conscious possession justify release.
