The Court granted bail to the petitioner, ordering release on a bond with specified conditions.

Summary

Bullet Yadav was arrested in connection with a robbery case (Vijayipur P.S. Case No. 241 of 2024) alleged under Section 309(4) of the B.N.S. The prosecution’s case is based solely on a confessional statement of a co‑accused, Gabbu Miya, in which Yadav’s name was mentioned; no material was recovered from Yadav and no other evidence links him to the offence. Yadav’s counsel argued that he is innocent and has been falsely implicated, while the State highlighted Yadav’s alleged 15 prior criminal cases. After hearing both sides, the Court noted the lack of substantive evidence against Yadav and, despite his antecedents, decided to grant bail. The bail was set at a bond of Rs. 10,000 with two sureties and conditions of regular court attendance, weekly police station reporting, and a close relative as one bailor. Yadav has been released on bail pending trial.

Issues considered

  • Whether bail should be granted when the only incriminating material is a co‑accused’s confessional statement.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
