The Court granted anticipatory bail to the petitioner, subject to stringent conditions, as the allegations did not warrant pre‑arrest detention.
Summary
The petitioner, Amit Kumar Ranjan, was named in a FIR (Makhdumpur PS Case No. 704 of 2025) for alleged offences under Sections 96 and 137(2) of the B.N.S., after the informant claimed her daughter had disappeared. The petitioner contended that the alleged missing girl was an adult who had voluntarily married him on 7 November 2025 and was living with him peacefully. The husband of the informant, Shiv Shankar Das, corroborated the marriage and submitted an affidavit supporting the petitioner’s claim. The State opposed the bail but acknowledged that both parties were adults and the marriage was accepted by the families. Considering the petitioner’s clean record, his young age, and the marital relationship, the Court granted anticipatory bail with a set of strict conditions.
Issues considered
- Whether anticipatory bail should be granted to the petitioner despite the FIR under Sections 96 and 137(2) of the B.N.S.
- Whether the marital relationship between the petitioner and the alleged missing adult woman negates the basis for the FIR.
