The court granted regular bail to the petitioner, directing his release upon furnishing the prescribed bail bond and sureties.

Summary

Petitioner Nitish Kumar was arrested after police claimed to have recovered 100.70 grams of heroin from his left pocket in a case under sections 8(c) and 21(b) of the NDPS Act. He contended that he was innocent and that the seizure violated procedural safeguards, specifically the non‑compliance of Section 105 of the Bihar Narcotic Substances Act and Section 50 of the NDPS Act during the search. The petitioner had been in judicial custody since 1 November 2025 and argued that the quantity seized, though more than a small quantity, was far below commercial quantity, warranting bail. The State opposed the bail application. After hearing both sides, the Patna High Court found merit in the procedural objections and the fact that the amount was not commercial, and consequently ordered the petitioner’s release on regular bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail in an NDPS case where the seized quantity exceeds the small‑quantity threshold but is less than commercial quantity.
  • Whether non‑compliance of Section 105 of the Bihar Narcotic Substances Act and Section 50 of the NDPS Act during seizure/search justifies granting bail.
