The court granted regular bail to the petitioner, directing release upon furnishing a bail bond of Rs.10,000 with two sureties.

Summary

The petitioner, Chandan Kumar Singh, applied for regular bail in a case registered under sections 334(1), 303(2) and 317(2) of the B.N.S., alleging theft from a PACS godown. The prosecution alleged that the petitioner, along with others, participated in the theft and that he was apprehended. The petitioner contended that he was falsely implicated, that no material was recovered from his possession, and that the mandatory requirements of Section 105 of the B.N.S.S. were not complied with. The State opposed the bail. After considering the facts, the court found merit in the petitioner's arguments and ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties of equal amount.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences under sections 334(1), 303(2) and 317(2) of the B.N.S.
  • Whether the mandatory provisions of Section 105 of the B.N.S.S. have been complied with in the investigation
  • Whether the petitioner’s antecedent criminal record precludes the grant of bail
