Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner with specified conditions.

Summary

The petitioner, Mohammad Adham, was arrested in connection with a theft case (Case No.81/2024) alleged under Sections 334(1) and 303(2) of the B.N.S. He sought regular bail, claiming innocence and that he had been in custody since 2 May 2025, while acknowledging one prior criminal antecedent. The State, represented by the Additional Public Prosecutor, opposed the bail. The Court examined the facts, noting the nature of the offences and the petitioner’s willingness to cooperate, and decided to grant bail. The order directed the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to appear at the Supaul Police Station every Sunday, with non‑appearance leading to cancellation. Consequently, the bail application was allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences under Sections 334(1) and 303(2) of the B.N.S. and his prior criminal antecedent
  • Whether conditions such as surety and regular police‑station attendance are sufficient for bail in this case
