Patna High Court

Ijhar Alam @ Ijhar MiyaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the petitioner's application for regular bail.

Summary

Ijhar Alam was arrested in connection with a murder alleged to have occurred during a chase, where co‑accused Katil Akhtar allegedly shot the victim. The petitioner was charged under Sections 103(1) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. He contended that he did not fire the weapon, was not on the same motorcycle as the shooter, and that the main accusation was against Katil Akhtar. The State opposed bail, but the court, after considering the custody period and the nature of the allegations, granted regular bail with a cash bond of Rs.10,000 and two sureties, subject to monthly police‑station attendance and cooperation in trial. The order was made on a prima facie basis and does not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under the Bharatiya Nyaya Sanhita and the Arms Act.
  • Whether the facts alleged against the petitioner justify denial of bail.
