The court held that, in the absence of direct evidence against the petitioners and given that the principal accused had already been released on bail, anticipatory bail could be granted to the petitioners under Section 482(2) of the B.N.S.
Summary
The petitioners Anwar Mahamad and others applied for anticipatory bail fearing arrest in a kidnapping‑for‑marriage case (Case No. 217 of 2024) under Section 96 of the B.N.S. The prosecution alleged that the petitioners, together with Nejamuddin, abducted the minor daughter of an informant for marriage. The petitioners contended they were falsely implicated, noting that the victim’s statement under Section 183 identified only Nejamuddin as the kidnapper and that Nejamuddin, who had already been granted bail, had married the victim, who was about 18‑19 years old. The court observed that there was no direct evidence against the petitioners, they had no criminal antecedent, and the main accusation rested on Nejamuddin who was already on bail. Consequently, the court ordered anticipatory bail for the petitioners, subject to surrender within four weeks, a bail bond of Rs.10,000 with two sureties, and conditions under Section 482(2) of the B.N.S. The order aims to ensure the petitioners’ appearance while protecting their liberty pending trial.
Issues considered
- Whether anticipatory bail can be granted to the petitioners under Section 482(2) of the B.N.S. in the present kidnapping‑for‑marriage case
- Whether the petitioners are likely to abscond, tamper with evidence, or influence witnesses
- Whether the prosecution’s evidence sufficiently links the petitioners to the alleged offence
