Patna High Court

Sumit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner.

Summary

The petitioner, Sumit Kumar, was arrested in connection with a murder case (Dumra P.S. Case No. 409 of 2024) alleging he tortured and killed his wife. He had been in custody since 23 October 2024 and the trial had not progressed to examination of any witness after charge framing. The petitioner’s counsel argued that the prolonged detention and delay in trial warranted bail under Sections 80 and 3(5) of the BNS. The High Court noted the extended period of custody and lack of trial progress, and consequently granted bail on a bond of Rs.10,000 with two sureties, subject to compliance with conditions. The order was limited to the bail application and did not prejudice the merits of the underlying criminal case.
