Holding

The court granted regular bail to the petitioner, subject to a bond and sureties.

Summary

Ashok Singh was arrested in connection with an excise case (PS No. 317 of 2020) where 3,000 litres of spirit were seized. He was charged under Sections 30(a) and 40(i) of the Bihar Prohibition and Excise Act and alleged to have fled the scene. The petitioner pleaded innocence, arguing that no contraband was found in his possession and that the case was based merely on suspicion, and he had been in judicial custody since 10‑12‑2025. The State opposed bail, citing two prior criminal cases against the petitioner. The High Court, after considering the facts, granted regular bail on a bond of Rs.10,000 with two sureties and imposed a condition that the petitioner not engage in similar offences in the future.

Issues considered

  • Whether regular bail can be granted to the accused under Sections 30(a) and 40(i) of the Bihar Prohibition and Excise Act despite the seriousness of the offence and the accused's prior criminal antecedents.

fled away after seeing the police party. It is further submitted

that the petitioner has been implicated in this case merely on
