Patna High Court

Chhotu Kumar @ Vikash KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to a bond and specified conditions.

Summary

The petitioner, Chhotu Kumar, was arrested on 14 February 2026 in connection with the recovery of 1,750 litres of illicit liquor alleged to have been taken from his house for delivery to a third party, under Section 30(a) of the Bihar Prohibition & Excise Amendment Act, 2022. He contended that the FIR was fabricated and that the only incriminating evidence was the statement of a co‑accused, Shyam Kumar, with no other material linking him to the offence, and that the investigation failed to comply with Section 103 of the BNSS, 2023. The State opposed bail, noting a pending case against the petitioner, but the court found the lack of substantive evidence and procedural lapse sufficient to grant bail. The court ordered release on a bail bond of Rs 10,000 with two sureties and imposed conditions regarding cooperation, presence in court, non‑tampering with evidence, and verification of criminal antecedents. The bail order was directed to be implemented without delay for verification purposes.

Issues considered

  • Whether the petitioner is entitled to bail despite the recovery of a large quantity of illicit liquor.
  • Whether the testimony of a co‑accused alone suffices to justify continued detention.
  • Whether non‑compliance with Section 103 of the BNSS, 2023 warrants bail.
  • Whether the petitioner’s pending criminal case affects the bail application.

                                 4. Learned counsel for the petitioner submits that the

petitioner is innocent and he has been falsely implicated in the

                       5. The learned Additional Public Prosecutor for the

State has vehemently opposed the prayer for bail of the

petitioner and submits that the petitioner carries one more case

of other than the present one but fairly submits on the basis of

paragraph-3 of the bail petition that the petitioner is on bail in

          the pending matter.

                       6. Considering the facts and circumstances of the case

and the fact that the name of the petitioner has been transpired
